The purpose of the Clarification Text Regarding the Processing of Personal Data of Visitors to This Website (“​​Clarification Text​​”) is to fulfill our obligation of clarification for visitors to our Website within the scope of Article 10 of the Personal Data Protection Law (the “​​Law​”) No. 6698 and the Communiqué on the Procedures and Principles to be Applied in Fulfilling the Clarification Obligation. – In this context, the data controller is M.B.İ.S. Bilgisayar Otomasyon Dan. ve Eği. Hiz. Tic.A.Ş. (“MBIS”) registered with the Istanbul Trade Registry with registration number 435070 and Mersis number 0609043428100018.

When contacting us via the forms on our website or the e-mails you send, you should not share your personal data other than those we request and/or your sensitive personal data in (e.g.   race or ethnicity, political opinion, religious or philosophical belief, physical or mental health, genetic/biometric data, association or union membership, attire, sexual life or disposition, data on criminal convictions and security measures, and criminal record).

  3. Your transaction security information — to prove that we are fulfilling our obligation as the data controller to inform, and to monitor and record the transactions that require explicit consent,
  4. In addition, all these data of yours can be processed by MBIS on the legal basis of “explicit consent” in accordance with the consent you give for commercial electronic messages (SMS, Call, E-mail) to be sent as per applicable laws for the purpose of announcing goods/services and invitations/events, conducting customer satisfaction surveys, and for promoting, advertising, promotions, sales and marketing purposes, and they can be transferred within the scope of the same purposes and legal basis.

4.         TO WHOM AND FOR WHAT PURPOSES DO WE NEED TO TRANSFER YOUR PERSONAL DATA?

In some cases, listed below, we may need to share (transfer) your personal data with the people and institutions from which we receive technological support and services, public institutions and organizations, and our group companies. In this context, we can send your personal data mentioned above to:

Based on your explicit consent that you give for the conditions stipulated in Article 3-d of this Clarification Text, your personal data can also be sent to the technology service providers who provide us with a service so that customized communications can be sent to you regarding MBIS goods and services and only on condition of being limited and proportional to that necessary for communication and digital interaction activities. However, we would like you to know that we do not share your personal data with other third parties.

Except for the cases regulated in Article 3-d of this Clarification Text, your personal data in question are processed without your explicit consent, based on the legal reasons stated in Article 5 of the Law and listed below: 

  • PDP Law, Article 5/2-c: It is necessary to process your personal data, provided that it is directly related to the conclusion of a contract between us and the performance of our existing contract  (It is necessary for the processing and fulfillment of requests from you (for example: e-book download request from the MBIS website)).

6.         WHAT RIGHTS DO YOU HAVE TO PROTECT YOUR PERSONAL DATA?

Your rights under Personal Data Protection Law No. 6698 are as follows:

  • To learn if your personal data have been processed or not,
    • If your personal data have been processed, to request information on how they were processed,
    • To learn the purpose of processing your personal data and whether your personal data were used in for the intended purpose,        
    • To learn about the third parties to whom your personal data are transferred within the country or abroad,
    • To request correction if your personal data have been processed incompletely or incorrectly,        
    • To demand the deletion or destruction of your personal data within the framework of the terms stipulated in the applicable regulations,        
    • To request notification of the correction, deletion, and destruction of your personal data to third parties in accordance with the relevant legislation,        
    • To object to any unfavorable outcome due your processed personal data being analyzed solely by automatic systems,        
    • To claim compensation if you incur losses due to the unlawful processing of your personal data.        

In terms of processing my personal data, I accept and declare that I have read and understood the Clarification Text above, that I have been informed separately and clearly with the Clarification Text regarding my rights listed in Article 11 of the Law, and that I can easily access a copy of the Clarification Text.
